En effectuant une réservation auprès de The Barn Oakenshaw Ltd (“ nous ”, “ notre ”, “ nos ”), vous (“ client ”, “ vous ”) acceptez d'être lié par les présentes Conditions générales. Ces conditions régissent votre séjour dans notre établissement ainsi que votre utilisation de notre site web et de nos plateformes de réservation.

 

1. Réservation et paiement

 

1.1 Bookings are only confirmed once full payment (or deposit if applicable) is received and you have received a written booking confirmation.

1.2 The person making the booking must be over 18 years old and accepts responsibility for all members of their party.

1.3 We reserve the right to cancel bookings where payment terms are not met.

 

2. Annulation et remboursements

 

2.1 We operate a strict No Refunds Policy. All bookings are non-refundable once confirmed.

2.2 This includes guest cancellations, early departures, and no-shows, regardless of the reason (e.g., illness, transport issues, weather, or personal emergencies).

2.3 By making a booking, you confirm that you understand and accept this no-refund policy in full.

2.4 In the rare event that we must cancel your booking due to unavoidable circumstances beyond our control (e.g., property damage, force majeure), a full refund will be provided. No further compensation will be offered.

 

3. Arrivée et départ

 

3.1 Check-in time: from 3:00 PM

3.2 Check-out time: by 10:00 AM

3.3 Early check-in or late check-out may be arranged in advance, subject to availability, and may incur an additional charge. Unauthorised late check-out may incur a charge of £30.00 per hour or part thereof. 

 

4. Utilisation de la propriété

 

4.1 The property is to be used for short-term holiday accommodation only.

4.2 No parties, events, or commercial photography are allowed without prior written consent.

4.3 Only guests included on the reservation and declared to The Barn Oakenshaw Ltd may enter or use the property and its facilities.

 

The maximum occupancy stated on the booking must not be exceeded at any time without prior written approval.

 

Day visitors are not permitted without prior written consent.

 

The lead guest must provide the names of all adult guests upon request and remains responsible for the conduct of all guests and visitors.

 

A £495.00 Daily Large Gathering Supplement applies where approved day guest numbers exceed 16 persons up to a maximum of 25 guests (no more than 16 guests overnight unless otherwise agreed). Also any Special Deal discounts will not apply.

 

Any person not included on the booking shall be considered a visitor and is not permitted on the property without prior written consent from the host. Any unauthorised guests or visitors may result in one or more of the following:

 

• An additional daily charge of £100.00 per unauthorised guest.


• Exceeding the maximum permitted guest numbers may result in immediate termination of the booking without refund.


• Refusal of entry to the property.


• Additional cleaning, security or administration charges where applicable.

 

The lead guest is responsible for ensuring all guests and visitors comply with these terms and must provide the names of all adult guests upon request.

 

The lead guest accepts full responsibility for all charges, damages, breaches of house rules and costs arising from the actions of any guest or visitor associated with the booking.

 

4.4 Smoking is not permitted anywhere throughout the site indoor/outdoor.

4.5 Vaping is permitted anywhere throughout the site indoor/outdoor.

4.6 Pets are not permitted anywhere throughout the site indoor/outdoor.

4.7 Noise, Nuisance & Respect for Other Guests

The Barn Oakenshaw is a family-friendly accommodation and guests must respect neighbouring properties and other guests staying on the estate.

Quiet hours apply between 10:00pm and 8:00am.

During this time, noise must be kept to a minimum, including outdoor conversations, music and social gatherings.

For guests staying in individual accommodation units (The Barn, The Log Cabin, The Oak and The Residence), hot tub use after 10:00pm must be conducted quietly and with consideration for other guests staying on the estate.

Where the Full Estate has been exclusively booked by a single group, guests may continue to use the facilities after 10:00pm provided noise is kept to a reasonable level and no nuisance is caused to neighbouring properties.

Any complaint of excessive noise, anti-social behaviour, nuisance, smoking in prohibited areas or disturbance to other guests may result in:

• A warning being issued
• Additional charges being applied
• Immediate termination of the booking without refund

 

4.8 CCTV & Property Monitoring

External CCTV operates in communal and exterior areas for the purposes of security, safety, crime prevention, occupancy verification and enforcement of house rules.

CCTV does not operate within any private internal accommodation areas.

By making a booking, guests acknowledge and consent to the use of external CCTV monitoring. CCTV footage may be used to verify occupancy levels, visitor numbers and compliance with house rules.

 

4.9 Complaints & Evidence of Breach

Any complaint received from another guest, neighbour, contractor, cleaner, member of staff or security provider regarding excessive noise, smoking, nuisance behaviour, unauthorised guests or breach of house rules may be relied upon as evidence when investigating a breach of these Terms & Conditions.

We reserve the right to use CCTV footage, photographs, videos, witness statements and written communications as evidence of any breach.

 

 

5. Responsabilités et comportement des invités

 

5.1 Guests must treat the property, contents, and surrounding area with care and respect.

5.2 You are responsible for any damage or loss caused during your stay, whether by you or any members of your party.

5.3 You must leave the property in a clean and tidy condition on departure.

6.1 We do not take a security deposit upfront. However, you will be held financially responsible for:

6.2 Charges will be made to the payment method used at booking or invoiced directly to the guest.

6.3 Failure to report damage before check-out may result in higher charges and possible ban from future bookings.

6.4 Additional Cleaning & Smoking Charges

Where smoking, vaping, excessive mess, stains, odours, bodily fluids, excessive rubbish or other breaches of house rules require cleaning beyond the standard turnover clean, guests will be charged the full cost of any additional labour, materials, specialist treatment, loss of income and any associated costs reasonably incurred.

7.1 We photograph and document the condition of the property before every guest stay.

7.2 Guests must submit accurate, truthful photos or videos when reporting damage or making a claim.

7.3 Strictly prohibited conduct includes:

7.4 If manipulation is detected:

7.5 Falsified claims may constitute civil or criminal fraud.

 

8. Responsabilité

 

8.1 We accept no liability for personal injury, illness, or loss of property during your stay, except where caused by proven negligence.

8.2 Use of facilities such as hot tubs, outdoor areas, and driveways is entirely at your own risk.

8.2.1 Use of the children’s play park, swings, climbing equipment, trampoline and all outdoor recreational facilities is entirely at the guest’s own risk and liability. Guests acknowledge that these facilities involve an inherent risk of injury. The Barn Oakenshaw Ltd accepts no liability for any accident, injury, loss or damage arising from their use. Parents and guardians must supervise children at all times.

8.2.2 The Log Cabin contains elevated mezzanine sleeping areas (“loft beds”) accessed by ladder-style stairs. Guests use these facilities entirely at their own risk and liability. The loft beds may not be suitable for young children, elderly guests, persons with reduced mobility, or anyone who may be at increased risk of falling. Parents and guardians are responsible for determining suitability and supervising children at all times. The Barn Oakenshaw Ltd accepts no liability for accidents, injuries or losses arising from the use of the loft sleeping areas.

8.3 Parents/guardians are responsible for supervising children at all times.

 

9. Utilisation et contenu du site Web

9.2 We strive for accuracy but are not liable for errors or omissions.

9.3 We may update these Terms at any time without notice.

10.3 Your data is used only to manage your booking, communication, and legal obligations.

 

11. Droit applicable

 

11.1 These Terms are governed by and construed in accordance with the laws of England and Wales.

11.2 Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

 

12. Special Offers, Promotional Rates & Occupancy Limits

 

12.1 Special offers, promotional rates, discounts, package deals and marketing promotions are offered at the sole discretion of The Barn Oakenshaw Ltd and may be amended, withdrawn or refused at any time.

12.2 Unless otherwise stated in writing, special offers and promotional rates do not apply during UK Bank Holiday periods, Christmas, New Year, or any other excluded dates specified by The Barn Oakenshaw Ltd.

12.3 Promotional rates are only valid where the booking remains within the property’s advertised maximum occupancy. Bookings exceeding the advertised guest capacity are not eligible for promotional rates.

12.4 Any request to exceed the property’s advertised occupancy limit must be disclosed and approved in writing by The Barn Oakenshaw Ltd prior to arrival. Approval may be granted or refused at our sole discretion and may be subject to additional charges, terms, conditions, security requirements, or event-specific agreements.

12.5 Any guest, visitor, attendee or occupant present at the property in excess of the authorised occupancy limit without prior written authorisation from The Barn Oakenshaw Ltd shall be deemed an unauthorised person and a material breach of these Terms and Conditions.

12.6 Any booking containing unauthorised guests, visitors or attendees, or otherwise exceeding the authorised occupancy limit without prior written approval, shall immediately become ineligible for any special offer, promotional rate, discount or package pricing.

12.7 Where unauthorised persons are found to be present at the property, The Barn Oakenshaw Ltd reserves the right to require the immediate removal of such persons or, at its sole discretion, terminate the booking and require all guests to vacate the property immediately.

12.8 In the event that a booking is terminated due to unauthorised guests, visitors, occupancy breaches, or failure to comply with occupancy restrictions, no refund, compensation, credit or alternative accommodation shall be provided.

12.9 The lead guest shall remain liable for any additional charges, losses, damages, cleaning costs, security costs, legal costs or other expenses incurred as a result of the breach.

 

 

13. Concierge Services, Events & Package Bookings

 

13.1 We will soon offer bespoke packages and concierge services, including:

• Forfaits golf et séjours à la campagne

13.2 Availability and pricing for these services are subject to custom quotation and may vary by season, group size, and supplier availability.

13.3 Additional booking terms, security deposits, contracts, or vendor-specific agreements may apply to events and services arranged on your behalf.

13.4 You accept full liability for the conduct of all guests and for any third-party contractors you hire through or independently of us.

13.5 We reserve the right to decline, cancel or terminate event-related bookings that pose unreasonable risk, breach local regulations, or cause nuisance to neighbours.

13.6 Refunds, if any, for concierge services will be governed by the vendor’s own cancellation policy — not our standard refund terms.

 

14. Acceptance of Terms

Politique relative aux crises, aux perturbations des transports et à la force majeure

 

1. Définition des événements de crise

 

Aux fins du présent accord, un “ événement de crise ” comprend (sans toutefois s’y limiter) :

 

  • Pénuries de carburant, rationnement du carburant ou augmentations importantes du coût du carburant
  • Pandémies, épidémies ou urgences de santé publique
  • Perturbations des transports, notamment des interruptions des transports ferroviaires, aériens, routiers ou publics
  • Recommandations ou avis gouvernementaux déconseillant les voyages
  • Guerre, conflit armé, terrorisme, troubles civils, émeutes ou événements liés à la sécurité nationale
  • Catastrophes naturelles, phénomènes météorologiques extrêmes ou risques environnementaux
  • Défaillances d'infrastructure ou perturbations des services régionaux/nationaux
  • Restrictions, réglementations ou pouvoirs d'urgence imposés par le gouvernement et affectant les voyages ou l'hébergement

 

2. Circonstances dans lesquelles un remboursement n'est pas requis

 

Lorsque les déplacements vers la propriété restent légalement autorisés et raisonnablement possibles, les réservations seront maintenues selon la politique d'annulation standard.

 

Cela comprend (sans toutefois s'y limiter) :

 

  • Situations où les clients choisissent de ne pas voyager en raison d'un risque perçu, d'un inconvénient ou d'un coût.
  • Pénuries de carburant ou rationnement lorsque des options de transport alternatives restent disponibles (y compris le train, le taxi ou d'autres moyens)
  • Guerre ou troubles survenant en dehors du Royaume-Uni et n'entraînant pas de restrictions des déplacements intérieurs
  • Perturbations générales des transports n'empêchant pas l'accès à la propriété
  • Une maladie personnelle ou des circonstances individuelles n'affectant pas la propriété elle-même

 

Dans de tels cas, aucun remboursement ne sera dû. Cependant, à notre discrétion, nous pouvons proposer :

 

  • Changement de date (sous réserve de disponibilité)
  • Un avoir pour un futur séjour
  • Un geste de bonne volonté partiel

 

3. Circonstances dans lesquelles un remboursement peut être accordé

 

Une réservation peut donner lieu à un remboursement total ou partiel dans les cas suivants :

 

  • Les restrictions gouvernementales rendent les déplacements vers la propriété illégaux ou formellement interdits.
  • La guerre, l'état d'urgence civile ou les mesures nationales restreignent directement les déplacements intérieurs au Royaume-Uni.
  • L'accès à la propriété est impossible en raison de fermetures obligatoires ou de restrictions officielles.
  • Nous sommes légalement tenus de cesser nos activités.
  • Le bien devient indisponible, dangereux ou impropre à l'occupation

 

Dans de tels cas, les remboursements seront limités à la partie non utilisée du séjour.

 

4. Réservations via plateformes (Airbnb, Booking.com, Vrbo, etc.)

 

Pour les réservations effectuées via des plateformes tierces, les conditions générales et les politiques de la plateforme concernée prévaudront.

 

Les clients reconnaissent que :

 

  • Les plateformes externes peuvent appliquer leurs propres “ circonstances exceptionnelles ” ou des politiques équivalentes (notamment en cas de guerre, de pandémie ou d’urgence nationale).
  • Les décisions de remboursement prises par ces plateformes peuvent prévaloir sur nos conditions d'annulation standard.
  • Nous ne sommes pas responsables des décisions prises indépendamment par des plateformes tierces.

 

5. Limitation de responsabilité

 

Nous ne serons pas responsables des pertes indirectes ou consécutives découlant d'événements de crise, y compris, mais sans s'y limiter :

 

  • frais de voyage
  • Hébergement alternatif
  • Perte de plaisir ou perturbation des plans

 

Notre responsabilité est strictement limitée au montant total de la réservation payée.

 

6. Bonne foi et utilisation équitable

 

Nous appliquons une approche juste et raisonnable, conformément à la Loi de 2015 sur les droits des consommateurs et viser à traiter tous les clients de manière équitable.

 

Les clients sont tenus d'agir de manière raisonnable et de ne pas demander de remboursement lorsque le séjour peut se dérouler légalement et en toute sécurité.
